Filshie Clips Lawsuit – Will it be a Class Action Status?
February 16, 2016 — San Diego, CA
The lawyers at National Injury Attorneys, LLC are currently investigating the Filshie Clips device as a possible class action lawsuit. Last week on February 11th, we were alerted to the many problems women have been facing using the Filshie Clips. (Over 10,000 women have seen our Facebook alert)
We were startled from hearing and reading so many problems (59 women have commented so far) associated with this device and we are looking for a possible class action status, but much legal work and discovery has to be done before we can proceed with any filing of complaints for a lawsuit.
Common Problems with Filshie Clips
The most common problems we’ve now collected seems to be the device migrating in women’s bodies (into the bladder or uterus), massive swelling, associated pain in or around the uterus, heavy menstrual flows, headaches, endometriosis, weight gain, stabbing pains and pain during intercourse.

How to File an FDA Adverse Event Report:
Anyone who has had and serious side effect from the Filshie Clips can use the new FDA Medwatch Mobile App available on their website: http://www.fda.gov/MedicalDevices/Safety/ReportaProblem/ucm385880.htm
From the FDA:
“MedWatcher is a mobile application (app) that allows individuals to submit voluntary reports of serious medical device problems to the FDA using a smart phone or tablet. The app makes it easier and faster for healthcare professionals, patients and caregivers to send voluntary reports of medical device problems to the FDA, compared to the traditional reporting methods – mail, phone or online.”
“The FDA relies on reports of serious problems with medical devices and other products as one important way to help identify and better understand the risks associated with these products. Receiving higher quality reports more quickly helps the FDA identify and respond to safety signals and public health emergencies more efficiently and effectively. These reports, along with data from other sources, can provide critical information that can lead to improved patient safety.”
Three common questions about Filshie Clips lawsuits people are asking us.
How much can you sue for a Filshie Clips lawsuit?
How much compensation would I get from a Filshie Clips lawsuit?
Has much is the settlements from a Filshie Clips lawsuit?
The answer to these questions can be difficult to predict, as the possible MDL (Multi-District Litigation) for this hasn’t started yet. There are statutes of limitations that apply to any personal injury lawsuit.
Some of the past defective medical device lawsuits have had millions of dollars set aside in a compensation fund, and then that is divided up between all who have joined the lawsuit. Example: $50,000,000 in a settlement fund that would serve 1,000 victims would be $50,000 per person. This is only an example and does not represent what may happen for Filshie Clips.
