Filshie Clips Lawsuit – Will it be a Class Action Status?

The lawyers at Hood National Law Group are currently investigating the Filshie Clips device as a possible class action lawsuit. Last week on February 11th, we were alerted to the many problems women have been facing using the Filshie Clips. (Over 10,000 women have seen our Facebook alert)

We were startled from hearing and reading so many problems (59 women have commented so far) associated with this device and we are looking for a possible class action status, but much legal work and discovery has to be done before we can proceed with any filing of complaints for a lawsuit.

Common Problems with Filshie Clips

The most common problems we’ve now collected seems to be the device migrating in women’s bodies (into the bladder or uterus), massive swelling, associated pain in or around the uterus, heavy menstrual flows, headaches, endometriosis, weight gain, stabbing pains and pain during intercourse.

The answer to these questions can be difficult to predict, as the possible MDL (Multi-District Litigation) for this hasn’t started yet. There are statutes of limitations that apply to any personal injury lawsuit.

Some of the past defective medical device lawsuits have had millions of dollars set aside in a compensation fund, and then that is divided up between all who have joined the lawsuit. Example: $50,000,000 in a settlement fund that would serve 1,000 victims would be $50,000 per person. This is only an example and does not represent what may happen for Filshie Clips.
