Big $12.5 Million Lawsuit Verdict for Woman Hurt from Transvaginal Mesh

January 7, 2016 — San Diego, CA.  Score a win for Patricia Hammons, the plaintiff, who was seriously injured by an Ethicon Prolift mesh implant.

It took less than 24 hours for the 12 jurors in a Philadelphia Court to reach a decision against Johnson & Johnson’s Ethicon Division. They award breaks down into one $5,500,000 million dollar compensatory verdict and $7,000,000 award in punitive damages.

An Ethicon Prolift mesh is a polypropylene implant used to treat pelvic organ prolapse (POP). Even though the product was taken off the market three years ago, many of these devices are still in use.transvaginal mesh implant

Problems with Ethicon Prolift mesh implant include: Device protrusion complications, urinary incontinence, bleeding, and vaginal shrinkage due to product contraction. The most severe complications with mesh implants are erosion and organ perforation.

The large $7 million in punitive damages is a clear warning to business to clean up their act; it’s a way of the court saying “stop your behavior”. Judge Mark Bernstein presided over the case in the Philadelphia Court of Common where 181 other pelvic mesh cases are pending.

This case is the second time a Prolift mesh case has gone to court, the first ended with a settlement last January for Joan Budke who died from a systemic infection that originated at the site of the pelvic mesh implant.

Product liability litigation over Johnson & Johnson/Ethicon pelvic mesh implants are scheduled in rapid succession during the first four months of 2016 and figures for fines or settlements could reach hundreds of millions of dollars.
